Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("User", "you") and Photoholics OÜ, registry code 14998427, address Salu tn 1, Ääsmäe küla, 76402 Saue vald, Harju maakond, Estonia ("Photoholics OÜ", "we", "us") governing your use of the Kinnisvara.AI service at kinnisvara.ai and app.kinnisvara.ai (the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Kinnisvara.AI is a software-as-a-service platform that generates social media posts and advertisements from Estonian real estate listing URLs using artificial intelligence. The Service can optionally publish generated content to Facebook Pages and Instagram Business accounts that you connect and authorize.

2. Account

To use the Service you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at paul@aisolutions.center if you suspect unauthorized access.

You must be at least 18 years old and legally capable of entering into a binding contract. If you register on behalf of a business, you represent that you have authority to bind that business.

3. Connecting Facebook and Instagram Accounts

If you connect a Facebook account to the Service, you authorize us to:

  • Read the list of Facebook Pages and Instagram Business/Creator accounts you administer

  • Publish posts, images, videos, and advertisements to the specific Pages and Instagram accounts you select inside the Service

  • Retrieve basic insights (impressions, reach, engagement) for content published through the Service

You may disconnect any account at any time from the Settings page. Doing so revokes our access tokens and prevents further publishing.

You are solely responsible for having the necessary rights and permissions to publish any content to any Facebook Page or Instagram account you connect. You confirm that you are an administrator of, or have authorization from the administrator of, every Page and account you connect.

4. Content

4.1 Your content

You retain all rights to the real estate listings, images, and any other content you provide to the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive, worldwide license to process Your Content solely for the purpose of providing the Service to you (including transmitting content to AI model providers for generation and to Meta for publishing).

4.2 Generated content

Content generated by the Service on your instructions ("Generated Content") is yours to use, publish, edit, and monetize. You are responsible for reviewing Generated Content for accuracy before publishing. AI-generated content can contain errors, and we make no warranty as to its accuracy, legality, or fitness for a particular purpose.

4.3 Prohibited content

You must not use the Service to generate or publish content that:

  • Violates any applicable law or third-party right

  • Contains false or misleading claims about real estate (price, size, location, ownership)

  • Infringes copyright, trademark, or personality rights

  • Is defamatory, harassing, hateful, or otherwise abusive

  • Violates the Facebook Community Standards or Instagram Community Guidelines

5. Acceptable Use

You must not:

  • Reverse engineer, decompile, or attempt to extract the source code of the Service

  • Use the Service to build a competing product

  • Bypass, disable, or interfere with security features

  • Use automated scraping, bots, or scripts to interact with the Service outside our official API

  • Publish content to Facebook Pages or Instagram accounts you are not authorized to manage

  • Use the Service in any way that could harm Photoholics OÜ, Meta, or any third party

We may suspend or terminate accounts that violate these rules without notice.

6. Fees and Payment

Some features of the Service require a paid subscription. Current pricing is shown at kinnisvara.ai/pricing. Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel at any time from your account settings, effective at the end of the current billing period.

Prices are in EUR and exclude applicable VAT unless otherwise stated. Estonian VAT is added where required by law.

Refunds are not provided for partially used billing periods except where required by law (e.g. 14-day right of withdrawal for consumers under EU consumer protection law).

7. Third-Party Services

The Service integrates with third-party services including Meta (Facebook, Instagram), Replicate, and payment processors. Your use of those services is governed by their own terms. We are not responsible for the availability, accuracy, or reliability of third-party services.

8. Intellectual Property

All rights, title, and interest in the Service (including software, design, trademarks, and documentation) are and remain the exclusive property of Photoholics OÜ. Nothing in these Terms transfers any intellectual property rights to you except the limited right to use the Service as expressly permitted.

9. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

  • The Service will always be available or uninterrupted

  • Generated Content will be accurate, complete, or free of errors

  • The Service will meet your specific requirements

  • Facebook Login or publishing will always succeed (this depends on Meta's systems)

10. Limitation of Liability

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, or 100 EUR, whichever is greater.

We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, lost data, or business interruption.

This limitation does not apply to liability that cannot be excluded under Estonian law (e.g. intentional misconduct, gross negligence, personal injury).

11. Termination

You may terminate your account at any time from your account settings. We may suspend or terminate your account if you materially breach these Terms, if we are required to do so by law, or if we cease to offer the Service. On termination, your right to use the Service ends immediately, and we will delete your data in line with our Privacy Policy.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notification at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Estonia, excluding its conflict of law rules. Disputes arising from or relating to these Terms shall be resolved by Harju County Court (Harju Maakohus) as the court of first instance, unless mandatory consumer protection law provides otherwise.

Consumers residing in the EU may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
